Final: Gaytansky’s shed near Iskar dam must be demolished and only the piggery must remain
The Supreme Administrative Court (SAC) has finally decided – Rumen Gaytansky ‘s „ Bio mining “ JSC, nicknamed Valka (translated as „ the wolf “) has to demolish the illegal construction near the Iskar dam . The decision came after the company appealed the order of Sofia’s Chief Architect Zdravko Zdravko to the Administrative Court, which decided the same.
The magistrates believe that the order of the capital’s Chief Architect, ordering „ Bio mining “ JSC to remove the illegal construction, is legal because it carried out the construction . The Supreme Court shared the reasons of the first instance about the illegality and intolerance of the construction. However, the decision to remove a one-story massive farm building /for the acclimatization of a wild boar/ and a one-story massive building – ancillary building to it is revoked.
We would like to remind you that the court was brought to court after it became clear that „ Bio Mining “ JSC had started a major construction project in the area of the Iskar dam. After an inspection by the Prosecutor’s Office, it became clear that numerous violations were committed – a building permit, an investment project, and construction supervision were missing. As a result, Arch. Zdravko Zdravko ordered the construction to be demolished. Gaytansky’s company and „ Southwestern State Enterprise “, to which the Iskar farm belongs, appealed the order, arguing that it was not a matter of new construction, but of the repair of an old shack.
The cassation panel of the Supreme Administrative Court shared the conclusion of the previous instance that the case concerns new constructions , the construction of which requires approved investment projects and a building permit in accordance with the requirements. These were not issued, which is why the buildings were correctly determined by the administrative body as illegal. The decision is final.
